Terms & Conditions

Effective Date: 12 March 2026

Welcome to 1790 Watches. These Terms and Conditions govern your access to and use of our website, products, and services. By visiting our website or placing an order, you agree to be bound by these Terms and Conditions.

If you do not agree to these Terms and Conditions, please do not use this website.

2. Eligibility and Use of Website

By using this website, you represent that you are at least the age of majority in your state of residence and that you will use this website only for lawful purposes.

You agree not to use the website:

for any unlawful, fraudulent, or harmful purpose
to violate any applicable law or regulation
to interfere with the security or proper functioning of the website
to attempt unauthorized access to any part of the website or related systems
to copy, scrape, reproduce, or exploit website content for commercial purposes without our written permission

We reserve the right to suspend or terminate access to the website for any user who violates these Terms and Conditions.

3. Products and Custom Made Orders

1790 Watches offers custom made products. Each watch is individually made to order.

Because each product is custom made, product photos, colors, finishes, painted details, and other visual elements may vary slightly from what appears on your screen or from prior examples. Minor variations do not constitute defects.

We reserve the right to modify, discontinue, or limit the availability of any product at any time without notice.

We also reserve the right to refuse or cancel any order for any lawful reason, including suspected fraud, product unavailability, pricing errors, or order issues.

4. Pricing and Payment

All prices are listed in US dollars unless otherwise stated.

We reserve the right to change prices at any time without notice. The price charged will be the price displayed at the time the order is placed, subject to correction of typographical, technical, or pricing errors.

Payments may be processed through third party providers such as Shop Pay, Stripe, PayPal, and Klarna. By submitting payment information, you represent that you are authorized to use the selected payment method and that the information provided is accurate.

We reserve the right to cancel any order if payment cannot be completed or verified.

5. Order Acceptance

Your order is an offer to purchase. An order is not accepted until we confirm it.

After you place an order, you may receive an order confirmation email. This email confirms receipt of your order request, but it does not necessarily mean that the order has been accepted.

We reserve the right to reject, limit, or cancel any order at our discretion, including after an order has been submitted.

6. Production and Shipping Time

All products are custom made to order. Please allow approximately 3 to 4 weeks for production before shipment.

This production timeline is an estimate only and is not a guaranteed ship date. We will make reasonable efforts to complete and ship orders within the stated timeframe. If we expect a delay beyond the advertised timeframe, we may contact you regarding the delay and your available options, including order cancellation where required by law. The FTC Mail, Internet, or Telephone Order Merchandise Rule requires sellers to have a reasonable basis for advertised shipping timelines and to provide delay notices and refund options in certain circumstances. (Federal Trade Commission)

Shipping times after dispatch depend on the carrier and destination. Delivery dates are estimates only and are not guaranteed unless expressly stated otherwise.

7. Shipping Address and Delivery Issues

You are responsible for providing a complete and accurate shipping address.

We are not responsible for delays, failed delivery, or additional costs caused by incorrect or incomplete shipping information supplied by the customer.

Risk of loss and title to products generally pass to you upon delivery to the shipping carrier, to the extent permitted by applicable law.

8. Returns, Exchanges, and Cancellations

Because our products are custom made to order, all sales are final unless the item arrives damaged, defective, or materially different from the item ordered.

[You should revise this section if you want to allow returns, exchanges, or cancellations before production begins.]

If your order arrives damaged or defective, you must contact us at [Insert Email Address] within [insert number] days of delivery and include your order number and clear photographs of the issue.

We reserve the right to determine whether a claimed defect, damage, or order error qualifies for replacement, repair, store credit, or refund.

9. Product Care and Use

You are responsible for using and caring for your watch properly.

Normal wear and tear, accidental damage, water damage beyond stated resistance limits, misuse, neglect, unauthorized modification, improper handling, or damage caused by third party repair or service are not considered defects.

Any care instructions, usage limitations, or product details provided on the website are part of the product information and should be followed.

10. No Warranty Except as Expressly Stated

Unless expressly stated otherwise in a separate written warranty policy provided with a product, all products and services are provided on an as is and as available basis to the fullest extent permitted by law.

To the fullest extent permitted by applicable law, 1790 Watches disclaims all implied warranties, including implied warranties of merchantability, fitness for a particular purpose, and non infringement.

However, if you provide a written warranty, federal warranty law may affect how warranty disclaimers work, and implied warranty limitations can be restricted in that context. The FTC explains that the Magnuson Moss Warranty Act governs written warranties on consumer products and limits disclaimer practices in certain situations. (Federal Trade Commission)

Important note: if you plan to offer any written repair warranty, movement warranty, or workmanship warranty, I should revise this section so it aligns with that warranty language.

11. Limitation of Liability

To the fullest extent permitted by law, 1790 Watches shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, loss of use, loss of data, or loss of goodwill, arising out of or related to your use of the website or purchase or use of any product.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the website, products, or these Terms and Conditions shall not exceed the amount you paid for the specific product giving rise to the claim.

Some states do not allow certain limitations of liability, so portions of this section may not apply to you.

12. Intellectual Property

All content on this website, including text, logos, graphics, images, product designs, product descriptions, layout, and other materials, is owned by or licensed to 1790 Watches and is protected by applicable intellectual property laws.

You may not use, reproduce, distribute, modify, display, or exploit any website content without our prior written permission.

13. Third Party Services and Links

Your use of third party services, including payment processors and external websites, is governed by the terms and policies of those third parties.

15. Website Accuracy and Availability

We try to ensure that website information is accurate, but we do not guarantee that product descriptions, pricing, availability, images, or other content will always be complete, accurate, current, or error free.

We reserve the right to correct any errors, inaccuracies, or omissions at any time without prior notice, including after an order has been submitted.

We do not guarantee that the website will always be available, uninterrupted, secure, or free from errors or harmful components.

16. Indemnification

You agree to defend, indemnify, and hold harmless 1790 Watches and its owners, affiliates, service providers, and representatives from and against claims, liabilities, damages, losses, and expenses, including reasonable attorneys fees, arising out of or related to your breach of these Terms and Conditions, your misuse of the website, or your violation of any law or third party right.

17. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles.

18. Dispute Resolution

Any dispute arising out of or relating to these Terms and Conditions, the website, or any purchase from 1790 Watches shall be resolved exclusively in the state or federal courts located in Polk County, Florida or the nearest appropriate court with jurisdiction, and you consent to the personal jurisdiction and venue of those courts.
